Snow Removal, Parking Ordinances Citizen Concerns
At City Council Meeting

Jamestown, ND (KCSi-T.V. News) -- The Jamestown City Council met in Regular Session, Monday evening at City Hall. All members were present.

Consent Agenda items discussed separately included:

Mayor Liechty requested Item “A” be discussed separately, with a separate vote, on a Resolution to approve the request for funding from Economic Development Funds to provide a Flex PACE Interest buy down for Custom Contracting LLC, for up to $16,000, with the City Share to be $12,800 and paid from the City Sales Tax Fund. Mayor Liechty. The Mayor stated the business is located outside of the city limits, and that the County should pay the 80-percent of the funding. Lindsey Larson of JSDC said the company plans to move within city limits in the next three months.
Schulz moved to approve the request.
The vote was 4-1 with Mayor Liecthy voting to oppose.

With Item “C” Mayor Liechty requested a separate discussion of a Resolution to concur with the NDDOT in developing a new Land Use and Transportation Plan for the City of Jamestown and agree to pay a local share of 20% (approximately $55,000) of the cost of the project. The Mayor questioned if the city is required to have a plan in place. She suggested reviewing the 1994 plan, before discussing the need of an updated version. Schulz says the Council’s mission includes, “planning for the future.” The Mayor moved to strike the Resolution from the agenda, and place the item on the next Public Works Committee meeting agenda to have the present plan in hand for discussion purposes.
The motion passed unanimously.


Item L: Mayor Liechty also requested to be discussed separately a Resolution to approve Payment to Interstate Engineering, Inc., for construction engineering services on 3rd
Street East Mill and Overlay from BNSF tracks to 87th Avenue, in the amount of $7,786.86.
The Mayor question if the dollars were part of the City’s $42,000 share of the funding. The amount would be paid for with federal stimulus dollars. The Mayor moved to approve, and passed unanimously.

Hearing from the audience:
Merlin Steele addressed the committee on graveling and snow removal in the alley in an area of 4th Avenue Northwest. He said the city has not acted, and he, has made improvements, for alley access. City Adminstrator Jeff Fuchs said the city “blades,” but does not remove snow from alleys, and gravel is placed at the discretion of the city. The Mayor suggested property owners ask for the alley to be paved.
A Jamestown College student complained about a citation for parking on the street, past the 48 hour limit, saying his car’s battery was dead. He has no off-street parking available. His car was then towed by the city.
He suggested a city plowing schedule, and inform the public on what days, which streets will be plowed. Mayor Liechty asked for a response from the Police Chief and City Engineer.
Chief Donegan said a vehicle needs to be moved at least three spaces, adding the police enforce the 48 hour parking limit.
A Northeast Jamestown resident who removed snow from the side of the street in front of a neighbor’s property onto that neighbor’s property, was cited for dumping snow on private property. Chief Donegan said he wouldn’t “try the case,” at the Council meeting, and added the property owner in Phoenix contacted him about the Jamestown neighbor placing snow on her property. Donegan said the man was cited for pushing snow onto private property.
Two such citations have been issued by the city, this winter. No action was taken by the Council. The Mayor suggested a Public Works Committee meeting addressing snow removal issues.

Mayor’s Report to the council, Mayor Liechty discussed sending letters to property owners on Business Loop East, and contacting them concerning sidewalks for the project.
She said she hopes the sub-committee is moving forward with the issue of the one percent city sales tax use, and the petition asking the city to look at using up to one half for infrastructure.

Other Business:

The City Council approved entering into a Cost Participation, Construction and Maintenance Agreement with the ND Department of Transportation for an Urban Federal Aid Project

Approved the request from Rocky Mountain Elk Foundation MinnDak Inc., Jamestown Chapter, for a site authorization to conduct gaming at the Gladstone Inn & Suites on
March 13, 2010.

Recognized the Post Graduation Party Committee as “other public spirited group, and authorized the issuance of a Raffle Permit, with the drawing on May 7th this year.

Approved and authorized entering into an agreement with Renaissance Recycling to provided recycling services to the community. Fuchs said the agreement includes the new subsidy request, otherwise it is indentical to the previous agreement.

City Council members discussed the previous Resolution of flood related damage to private property. The Mayor declared a conflict of interest on the topic. She said her private driveway was used as access to install flood control in her neighborhood. City Administrator Fuch said those with damaged property have been contacted with the city’s decision on addressing claims, relative to city responsibility, to pay claims, and the insurance company’s payment of claims, and the scope of damages the city would pay for. The Council will then decide on any payment of claims on behalf of the city.
Councilman Schulz moved to follow through with the city’s original Resolution to do that, which passed.
