Court Upholds Dismissal, Lawsuit Filed By Jamestown Inmates
BISMARCK, N.D. (AP) - An appeals court has upheld the dismissal of a 2003 gender discrimination lawsuit filed by female North Dakota prison inmates.
U.S. District Judge Daniel Hovland in November 2007 dismissed the lawsuit filed by Julie Roubideaux and Shelly Grossman, who were serving time in a Jamestown prison.
The women, who sued on behalf of all female inmates in the state prison system, alleged the system gave female inmates fewer opportunities for treatment, education and work.
Hovland ruled that the women failed to prove discrimination, and a three-judge panel of the St. Louis-based 8th U.S. Circuit Court of Appeals has agreed with him.
Attorney General Wayne Stenehjem says the court adopted the state's argument that the problems of prison administration and reform are not for the courts but instead for the executive and legislative branches of government.
